Andy, I’m being really patient with you. This is your last chance to do the right thing<\/strong>.<\/p>\n\n\n\n

You entered into an agreement to carry out work on my BMW R80RS. At first this was verbal – which is still binding in law – but then it was immediately confirmed in writing.<\/p>\n\n\n\n

Beyond that, in consumer law, the relationship between a service provider and a consumer is assumed to be contractual. It is implied by conduct, a so called “silent contract”, as per the Consumer Rights Act 2015.<\/p>\n\n\n\n

This carries the same legal weight and obligations as a written contract.<\/strong><\/p>\n\n\n\n

If you now claim that “there was no contract”. If so, please explain why anyone would pay to have their motorcycle transported further away from their home without any agreement? Then spend 4 hours to come down and see you, and to pay for the cost to do so. <\/p>\n\n\n\n

Better still, provide evidence which contradicts the fact that<\/strong> it was to have works carried out to it by you.<\/strong><\/p>\n\n\n\n

If you now want to break that contract, you will need to pay my costs and losses, including denying my use of the vehicle for the whole or a perfect riding season.<\/p>\n\n\n\n

I am the owner. You do not have my permission to sell it. <\/strong><\/p>\n\n\n\n

If you now steal it, and sell it without my permission, I will report it to the Police and the DVLA, and take you to court for my costs, losses … and a ‘like for like<\/strong>‘ replacement. <\/p>\n\n\n\n
